FORD MARKETPLACE TERMS

These Marketplace Terms (“Terms”) govern the use the Ford Marketplace (available on www.ford.co.uk) (“Ford Marketplace”). The Ford Marketplace is operated by is operated by Ford Motor Company Limited, a company incorporated in England and Wales (Company No. 00235446) whose registered office is at Arterial Road, Laindon, Essex, England, SS15 6EE (“Ford”). 

These Terms do not alter in any way the terms or conditions of any other agreement you may have with us or other Ford companies. These Terms contain important information about the Ford Marketplace.  By using the Ford Marketplace, you acknowledge that you have read and understood these Terms, and that you agree to be bound by them.

1. Order Process

Vehicles

Through the Ford Marketplace, you can configure selected new Ford vehicles and place orders with participating Ford dealers. As part of the order process, you will select the Ford dealer with whom you will place your order (your “Dealer”). You will be required to enter into an order form with your Dealer, setting out key information about your order and your Dealer’s terms and conditions. You should read these documents carefully before proceeding.

Cash purchases: you will have the option to purchase your selected vehicle outright in cash from your Dealer. This purchase will be between you and your Dealer. Please see your Dealer’s terms and conditions for more information. 

Finance: you may have the option to apply for finance from selected providers. Please note that finance is subject to status and minimum deposit restrictions may apply. 

Wallboxes

For selected battery electric/plug-in hybrid vehicles, you may have the option to order a wallbox.  

On the Ford Marketplace, you can order an available wallbox from your Dealer as an accessory (without installation included). See Section 3 below for more information on accessories.

If you wish to order a wallbox with installation, this can be arranged with British Gas.

Part Exchange

On the Ford Marketplace, you can arrange for the part exchange of your existing vehicle. You could apply the funds towards your deposit for your new vehicle. Your part exchange will be handled by your Dealer. Your vehicle valuation will be based on what you have told us on the Ford Marketplace and the estimated delivery date of your new vehicle. Please see your Dealer’s terms and conditions for more information.

If there is any outstanding finance on your existing vehicle, you must ensure that information submitted by you to us relating to your existing finance is accurate and up to date. You are responsible for settle the outstanding finance (unless agreed differently with your Dealer).

2. Vehicle Price

When you order a vehicle through the Ford Marketplace, your Dealer will provide an On The Road cash price for your chosen vehicle as part of the checkout process. This On The Road cash price is valid on the date of order. Please note that changes to government legislation, currency conversion rates and tax changes could impact the On The Road cash price.

3. Options and Accessories

If, through the course of this process, you add certain optional factory fitted features or available accessories to your selected vehicle, the Dealer’s price of such features will be added to the vehicle price.

You may have the option to order third party accessories, which are identified under that third party's brand name. Please note that third party branded accessories do not come with a Ford warranty but may be covered by the third party’s own warranty, details of which will be included within the packaging that the accessories are supplied in.  

4. Payments

If you place an order for a vehicle through the Ford Marketplace, your Dealer may require you to pay a refundable reservation fee. Your Dealer will specify the amount as part of the checkout process. You will need to make this payment using a selected debit or credit card at checkout, please see the Payment Terms in Annex 1 below for more information.

Remaining Balance: you will need to pay your Dealer any remaining balance for the vehicle prior to receiving the vehicle. Your Dealer will contact you to arrange this. 

Delivery and other charges: your Dealer may charge you an additional charge for the cost of delivery (where available) and additional charges for other services/support provided. In this case, your Dealer will provide the charge amount(s) to you as soon as possible (including as part of the checkout process).  

5. Vehicle Imagery

The vehicles available to order through the Ford Marketplace are from our current manufactured range. The images of the vehicles and the size and dimension icons and indicators on the Ford Marketplace are for illustrative purposes only. Although we have made every effort to display the sizes and colours of our vehicles, accessories and trim accurately, we cannot guarantee that your PC, laptop, tablet or phone will display the sizes or colours accurately to reflect the actual size or colour of the vehicles. Your new vehicle may vary slightly from those images.

We may, from time to time, make minor changes to our vehicle specifications to implement small technical adjustments.

6. Ford Programmes & Cross Border Sales

Ford programmes

Please note that you cannot use the following programmes on orders made through the Ford Marketplace: (i) Ford Privilege; (ii) Ford Ambassador; (iii) D-Plan programmes; (iv) Ford Advantage Programme; (v) Ford Fleet; (vi) Motability; and (vii) Military and Diplomatic personnel sales. 

Cross Border Sales 

For cash sales, if your selected Dealer is not located in your country of residency, please be aware that your Dealer may not offer the option of home delivery to your country of residency and you will therefore need to collect the vehicle from the Dealer’s premises. You should take tax advice before placing an order should you intend to permanently move the vehicle to a different country.

7. Changing Your Mind

If you are unable or do not wish to proceed with your order, please contact your Dealer as soon as possible to discuss your options.  

Furthermore, Ford may terminate or suspend your access to the Ford Marketplace at any time (acting reasonably) by written notice (including by e-mail to your current registered email address) for reasons including (but not limited to) the following:

  • you commit a serious or persistent breach of a term which you fail to remedy (if remediable) within 5 days after the service of written notice requiring you to do so; or
  • (in the reasonable opinion of Ford) circumstances beyond the reasonable control of Ford impairs or prevents Ford from the Ford Marketplace or products.

8. Account & Password

Ford account

Where you create a Ford account, you will be asked to provide a user name and password. This will allow you to access your ordered vehicles. You must keep the password secure and must not share it with any other person. We are not responsible for any misuse of your Ford account where you have caused your username and password to be known by another person.

You must tell us as soon as possible if you think your password has been shared or your Ford account has been accessed without your authority. We may disable your account immediately if we know of or suspect any misuse. 

9. Vehicles/Product Assistance 

In the event that you believe the vehicle/product is defective or mis-described or you believe a fault develops with your vehicle/product, then please contact your Dealer as soon as possible (as a delay in doing so might affect any remedy available to you). Your dealer will discuss your rights and remedies with you. 

If you feel that a vehicle/product you have ordered from us is unsatisfactory, please contact your Dealer as soon as possible (as a delay in doing so might affect any remedy available to you). Your Dealer will discuss your rights and remedies with you. 

Ford will provide the Ford Marketplace platform through which you can order selected vehicles/products from participating Ford dealers (who are independent operating businesses) and other selected third parties. Ford will not be the seller or supplier of the vehicles/products on the Ford Marketplace. As a result, Ford does not control and assumes no responsibility for the sale/supply of the vehicles/products to you by the Ford dealers and other third party sellers.

11. General

11.1 We may at any time, without limiting any other rights and remedies it may have, set off any amount owing to you against any amount payable by you to us.

11.2 No waiver by either party of any breach of the Marketplace Terms shall be considered as a waiver for any subsequent breach of the same or any other provision.

11.3 If any provision or part of any provision of these Marketplace Terms is found by a court or other competent authority to be void or unenforceable, such provision or part of a provision shall be deleted from these Marketplace Terms and the remaining provisions or parts or the provision shall continue to full force and effect. 

11.4 These Marketplace Terms are governed by English Law and the parties agree to the exclusive jurisdiction of the English courts.

12.2 The Motor Ombudsman

Whilst acting as a consumer, if a non-financial services related dispute arises that cannot be resolved between us within a reasonable timescale, you may refer the dispute to the free independent Advisory and Conciliation Service operated by The Motor Ombudsman, the government-backed, self-regulatory body for the motor industry. Ford Motor Company Limited and your Dealer is willing to engage with this type of dispute resolution. Annex 1 – Payments 

1. Payments made at checkout on the Ford Marketplace will be processed using a third-party payment service provider. You acknowledge and agree that these payments are solely between you and your selected Dealer or third party seller. You authorize the payment service provider to collect, analyze and relay information generated in connection with these payments. Furthermore, these payments are subject to the terms and conditions governing your card and to any agreements between you and your financial institution.

2. Security Details and Verifying Your Identity:

You may be required to verify that you are the authorized controller of your payment card in order to complete a payment. So you may need to set up security passcodes, passwords, security questions and similar information (including fingerprint, face recognition or other biometric information) (“Security Details”). As long as the payment processing systems have checked your identity by verifying the Security Details, we will assume that we are dealing with you and that you have agreed to us disclosing information to you and acting on any instruction without getting further confirmation from you.

You agree:

  • not to give your Security Details to anybody;
  • not to write down your Security Details in a way that they could be understood by anyone else; and
  • to make sure no-one else sees you enter your Security Details when you’re making a payment on the Ford website.

You must tell us as soon as you can if:

  • someone else knows your Security Details (or you think they may do);
  • you see any mistakes or unauthorised payments; or
  • you think someone else has or has tried to use your payment method.
  • We may ask you to change your Security Details for operational or security reasons.

3. Availability and liability.

You can usually use the Ford Marketplace at any time but sometimes repairs, updates and maintenance on our systems and those of our suppliers may mean that some of the payment features on the website may be slower than normal or temporarily unavailable. We will not always be able to let you know when a payment feature won’t be available and we won’t be responsible for any losses you suffer as a result of such unavailability or where a payment feature is not working properly for other reasons outside of our control. For example, this includes where there is a failure to complete a transaction in accordance with your instructions. Nothing in these terms and conditions shall (a) exclude or limit Ford’s or your selected Dealer’s liability for gross negligence, willful misconduct or other cases in relation to which liability cannot be excluded or limited under the applicable law, or (b) prejudice consumer rights granted by the applicable law.

4. Money laundering and terrorist financing: 

We may gather and verify information in relation to your identity before providing products and services to you. We may ask you, at any time, to supply additional information to help us to do this, and you should supply such information promptly. We will comply with all of our reporting and notification obligations under applicable anti-money laundering and financial crime rules and we may, at any time and without notice/explanation, suspend or terminate the products and services we provide to you if we have a concern about money laundering and/or financial crime risks.
