These Mustang Mach E Pre-Order Terms and Conditions (“Pre-Order Terms and Conditions”) contain important information regarding the Mustang Mach E Pre-Order Programme (the “Pre-Order Programme”). Please read these Pre-Order Terms and Conditions carefully.
The Pre-Order Programme is operated by Ford Motor Company Limited, a company incorporated in England and Wales (Company No. 00235446) whose registered office is at Arterial Road, Laindon, Essex, England, SS15 6EE (“Ford”) and participating Ford dealers. By participating in the Pre-Order Programme, you represent that you have read and accept these Pre-Order Terms and Conditions.
1. PRE-ORDER PROGRAMME
We are conducting this Pre-Order Programme for the introduction of the Mustang Mach E. The purpose of the Pre-Order Programme is to allow potential purchasers to configure a Mustang Mach E model, select a Ford dealer (“Dealer”) and pay any pre-order deposit to this Dealer.
To participate in the Pre-Order Programme, you must be 18 years of age or older and capable of entering into legally binding agreements. Please note that households can place a maximum of two pre-orders in total.
CONFIGURE A VEHICLE
Through the Ford website www.ford.co.uk and your selected Dealer, you can configure a Mustang Mach E by requesting:
- a desired model;
- a desired battery;
- a desired drive train (e.g Rear Wheel Drive or All Wheel Drive);
- a desired exteriour colour;
- desired optional features.
Please note that due to the complexities of the vehicle build process, we are unable to confirm the technical specifications for your desired Mustang Mach E during the pre-order phase. You will have the option to review full technical specifications including final consumption and emission data at a later phase in the order process (see Section 3 (Next Steps) below for more information).
SELECT A DEALER
On the Ford website, you will select a Dealer with whom you will transact during the Pre-Order Programme. You will continue to transact with this Dealer as part of the full Mustang Mach E order process (if you decide to proceed with an order).
You may need to pay your Dealer a pre-order deposit in order to participate in the Pre-Order Programme. Your Dealer will specify any deposit amount as part of the checkout process on the Ford website. If you decide to withdraw from the Pre-Order Programme, the pre-order deposit will be refunded to you (see Section 4 (Changing Your Mind) below for more information).
Payments made on the Ford website for the Pre-Order Programme will be processed using a third-party payment service provider. Please see Annex 1 (Payments) for more information.
As part of the Pre-Order Programme, an ‘indicative recommended retail price’ is displayed on the Ford website. This price is not a final transaction price. It is an indication or guide to help consumers choose between the different specifications of vehicles available during the pre-order phase. Final transaction prices for the Mustang Mach E will be confirmed by your selected Dealer at a later phase in the order process (see Section 3 (Next Steps) below for more information).
2. NOT AN OFFER OR CONTRACT FOR SALE
The purpose of the Pre-Order Programme is to identify potential Mustang Mach E purchasers. The Pre-Order Programme is not an offer by Ford or any Ford dealer to sell a Mustang Mach E. If you chose to participate in the Pre-Order Program, this is not an offer by you to purchase a Mustang Mach E.
Please note that the Mustang Mach E is not yet available to purchase. The earliest forecast date for purchase/ordering is May 2020, but this is only an estimate. Sales of the Mustang Mach E will only be made by participating Ford dealers through the Ford website.
Participating in the Pre-Order Programme is only an indication of your potential interest in purchasing a Mustang Mach E. If you participate, there is no guarantee that you will be offered an opportunity to purchase a Mustang Mach E, because the terms of any purchase are subject to mutual agreement by the pertinent seller (i.e. participating Ford dealer) and the prospective purchaser. Mustang Mach Es will be delivered only to locations in which sale and delivery of the Mustang Mach E is lawful.
Please note that the Pre-Order Programme is not a lottery, sweepstakes, contest, game, commercial competition, prize competition or promotion.
3. NEXT STEPS
You will receive an email in Spring 2020 inviting you to convert your pre-order into an order through the Ford website. You will have 30 days from receipt of your invitation email to place an order.
- Please note that due to the complexity of the vehicle build process, certain configurations selected in the pre-order phase may not be available. If you do not wish to continue in the order process, you have the option to withdraw (see Section 4 (Changing Your Mind) below for more information).
- You will be provided with the full technical specifications (including final consumption and emission data) for the available Mustang Mach E model. A full and final On The Road transaction price will also be provided by your Dealer. You will be asked to review this information and confirm that you are happy to continue in the order process. Following your confirmation, this Mustang Mach E model will be scheduled for build.
- Please note that if you do not make this confirmation within the 30 day period, your pre-order may be cancelled. In this case, your pre-order deposit will be fully refunded (in accordance with Section 4 (Changing Your Mind) below).
PAYING FOR A VEHICLE / APPLYING FOR FINANCE
In Summer 2020, you will be asked to indicate how you plan to pay for your chosen Mustang Mach E and where applicable, apply for finance.
Please note that if you do not indicate your payment method within 30 days, your order may be cancelled, in which case your pre-order deposit will be fully refunded (in accordance with Section 4 (Changing Your Mind) below).
CROSS BORDER SALES
For cash sales: if your selected Dealer is not located in your country of residency, please be aware that your Dealer may not offer the option of home delivery to your country of residency and you will therefore need to collect the vehicle from the Dealer’s premises.
For financed transactions: please note the finance provider may have certain eligibility criteria, which may impact who can apply for finance (depending on their country of residence).
4. CHANGING YOUR MIND
You may withdraw from the Pre-Order Programme at any time by accessing your Ford account on the Ford website www.ford.co.uk and clicking the cancellation button.
If the pre-order is cancelled, you will receive a full refund of the pre-order deposit paid from your selected Dealer. Your refund will be processed without undue delay and not later than 7 days after the day on which your Dealer is informed about your decision to cancel.
Your refund will be made using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the refund.
Furthermore, both Ford and your Dealer may terminate the Pre-Order Programme, or suspend temporarily part of it, at any time (acting reasonably) by written notice (including by e-mail to your current registered email address) for reasons including (but not limited to) the following:
- you commit a serious or persistent breach of a term which you fail to remedy (if remediable) within 5 days after the service of written notice requiring you to do so; or
- (in the reasonable opinion of Ford or Dealer) circumstances beyond the reasonable control of Ford or Dealer impairs or prevents the continued operation of the Pre-Order Programme.
5. INFORMATION ABOUT THE MUSTANG MACH E
The Mustang Mach E is still at pre-production stage. The information and technical characteristics, including price of the Mustang Mach E on the Ford website is therefore provisional and subject to change. Final information about the technical characteristics of the Mustang Mach E (including final consumption and emission data, plus final dealer transaction price) will be confirmed before you have the option to place an order with Your Dealer for an available Mustang Mach E. Although we have made every effort to display colour options of the Mustang Mach E accurately, we cannot guarantee that any PC, laptop, tablet or phone will display the colours correctly.
6.1 Your selected Dealer may at any time, without limiting any other rights and remedies it may have, set off any amount owing to you against any amount payable by you to your Dealer.
6.2 You are not allowed to assign any rights and/or obligations under the Pre-Order Programme to any third parties.
6.3 No waiver by either party of any breach of the Pre-Order Terms & Conditions shall be considered as a waiver for any subsequent breach of the same or any other provision.
6.4 If any provision or part of any provision of these Pre-Order Terms & Conditions is found by a court or other competent authority to be void or unenforceable, such provision or part of a provision shall be deleted from these Pre-Order Terms & Conditions and the remaining provisions or parts or the provision shall continue to full force and effect.
6.5 These Pre-Order Terms & Conditions are governed by the law of England and Wales and the parties agree to the exclusive jurisdiction of the courts of Courts of England and Wales.

ANNEX 1 – PAYMENTS
1. Payments made on the Ford website for the Pre-Order Programme will be processed using a third-party payment service provider. You acknowledge and agree that payments for the Pre-Order Programme are solely between you and your selected Dealer. You authorize the payment service provider to collect, analyze and relay information generated in connection with these payments. Furthermore, these payments are subject to the terms and conditions governing your card and to any agreements between you and your financial institution.
2. Security Details and Verifying Your Identity:
You may be required to verify that you are the authorized controller of your payment card in order to complete a payment. So you may need to set up security passcodes, passwords, security questions and similar information (including fingerprint, face recognition or other biometric information) (“Security Details”). As long as the payment processing systems have checked your identity by verifying the Security Details, we will assume that we are dealing with you and that you have agreed to us disclosing information to you and acting on any instruction without getting further confirmation from you.
- not to give your Security Details to anybody;
- not to write down your Security Details in a way that they could be understood by anyone else; and
- to make sure no-one else sees you enter your Security Details when you’re making a payment on the Ford website.
You must tell us as soon as you can if:
- someone else knows your Security Details (or you think they may do);
- you see any mistakes or unauthorised payments; or
- you think someone else has or has tried to use your payment method.
We may ask you to change your Security Details for operational or security reasons.
3. Availability and liability.
You can usually use the Ford website at any time but sometimes repairs, updates and maintenance on our systems and those of our suppliers may mean that some of the payment features on the website may be slower than normal or temporarily unavailable. We will not always be able to let you know when a payment feature won’t be available and we won’t be responsible for any losses you suffer as a result of such unavailability or where a payment feature is not working properly for other reasons outside of our control. For example, this includes where there is a failure to complete a transaction in accordance with your instructions. Nothing in these terms and conditions shall (a) exclude or limit Ford’s or your selected Dealer’s liability for gross negligence, willful misconduct or other cases in relation to which liability cannot be excluded or limited under the applicable law, or (b) prejudice consumer rights granted by the applicable law.
4. Money laundering and terrorist financing:
We may gather and verify information in relation to your identity before providing products and services to you. We may ask you, at any time, to supply additional information to help us to do this, and you should supply such information promptly. We will comply with all of our reporting and notification obligations under applicable anti-money laundering and financial crime rules and we may, at any time and without notice/explanation, suspend or terminate the products and services we provide to you if we have a concern about money laundering and/or financial crime risks.
