NEW ALL-ELECTRIC EXPLORER RESERVATION TERMS AND CONDITIONS
These Reservation Terms and Conditions (“Reservation Terms and Conditions”) contain important information regarding the New All-Electric Ford Explorer Reservation Program (the “Reservation Program”). Please read these Reservation Terms and Conditions carefully.
The Reservation Program is operated by Ford Motor Company Limited, Arterial Road, Laindon, Essex, SS15 6EE (“Ford”). By participating in the Reservation Program, you confirm that you have read and accept these Reservation Terms and Conditions.
1. RESERVATIONS PROGRAM
We are conducting this Reservation Program for the introduction of the New All-Electric Ford Explorer (“vehicle”). The purpose of the Reservations Program is to allow potential purchasers early access to Ford’s e-commerce platform for the opportunity to configure and order the vehicle (see Section 3 below for more information on how early access works).
To participate in the Reservation Program, you must be 18 years of age or older and capable of entering into legally binding agreements. Please note that each individual can place a maximum of two reservations in total.
2. NOT AN OFFER OR CONTRACT FOR SALE
The purpose of the Reservation Program is to identify potential vehicle purchasers. The Reservation Program is not an offer by Ford or any Ford dealer to sell a vehicle. If you chose to participate in the Reservation Program, this is not an offer by you to purchase a vehicle.
Please note that the vehicle is not yet available to purchase. The forecast timeframe for ordering is [Spring 2024], but this is only an estimate. Sales of the vehicle will only be made by participating Ford dealers through the Ford website.
Participating in the Reservation Program is only an indication of your potential interest in purchasing a vehicle. If you participate, there is no guarantee that you will be offered an opportunity to purchase a vehicle, because the terms of any purchase are subject to mutual agreement by the pertinent seller (i.e. participating Ford dealer) and the prospective purchaser. Vehicles will be delivered only to locations in which sale and delivery of the vehicle is lawful.
Please note that the Reservation Program is not a lottery, sweepstakes, contest, game, commercial competition, prize competition or promotion."
3. EARLY ACCESS
You will receive early access to Ford’s e-commerce platform for the opportunity to configure and order an available model. This is expected to be in Spring 2024. You will be informed when the early access will start from and expire. Only customers participating in the Reservation Program can place orders for models during this time. When early access expires, all customers (including those without reservations) will be able to order models through Ford’s e-commerce platform.
4. CHANGING YOUR MIND
You may withdraw from the Reservation Program at any time using the following method(s):
- Access your Ford Account on the Ford website, select your Reservations and [click cancellation button]; or Contacting Ford at 020 3564 4444.
5. INFORMATION ABOUT THE ALL-ELECTRIC SUV
The vehicle is still at pre-production stage. The information and technical characteristics on the Ford website is therefore provisional and subject to change. Final information about the technical characteristics of the vehicle (including final energy consumption and range data) will be confirmed before you have the option to place an order on the Ford website. Although we have made every effort to display colour options of the vehicle accurately, we cannot guarantee that any PC, laptop, tablet or phone will display the colours correctly.
6. GENERAL
6.1 You are not allowed to assign any rights and/or obligations under the Reservation Program to any third parties.
6.2 No waiver by either party of any breach of the Reservation Terms & Conditions shall be considered as a waiver for any subsequent breach of the same or any other provision.
6.3 If any provision or part of any provision of these Reservation Terms & Conditions is found by a court or other competent authority to be void or unenforceable, such provision or part of a provision shall be deleted from these Reservation Terms & Conditions and the remaining provisions or parts or the provision shall continue to full force and effect.
6.4 You can usually use the Ford website at any time but sometimes repairs, updates and maintenance on our systems and those of our suppliers may mean that some of the features on the website (including the payment feature) may be slower than normal or temporarily unavailable. We won’t always be able to let you know when a website feature won’t be available and we won’t be responsible for any losses you suffer as a result of such unavailability or where a feature is not working properly for other reasons outside of our control. For example, this includes where there is a failure to complete a transaction in accordance with your instructions. Nothing in these Reservation Terms & Conditions shall (a) exclude or limit Ford’s liability for gross negligence, wilful misconduct or other cases in relation to which liability cannot be excluded or limited under the applicable law, or (b) prejudice consumer rights granted by the applicable law.
6.5 These Reservation Terms & Conditions are governed by the local law of your country of residence and the parties agree to the exclusive jurisdiction of the courts of your country of residence.
6.6 Money laundering and terrorist financing: We may gather and verify information in relation to your identity before providing products and services to you. We may ask you, at any time, to supply additional information to help us to do this, and you should supply such information promptly. We will comply with all of our reporting and notification obligations under applicable anti-money laundering and financial crime rules, and we may, at any time and without notice/explanation, suspend or terminate the products and services we provide to you if we have a concern about money laundering and/or financial crime risks.
